If hosting is required for the website, Linkni Internet Solutions Ltd will set up web hosting for Client with a professional hosting company known to be reliable. Linkni Internet Solutions Ltd makes no guarantees as to minimum “uptime” regarding hosting services that we offer and shall not be held responsible for any direct, indirect, special or consequential damages resulting from possible lapses in hosting services. Such possible damages include any lost profits or business interruption or loss of digital data.
Hosting accounts are payable in advance and for a 12 month period.
Note all hosting accounts are of a fixed size and finite – therefore we insist clients use POP settings for their main email accounts with settings set to remove email from the server no longer than 60 days. Other devices such as phones and tablets may use IMAP settings. If email is required to be stored on the cloud, we encourage our clients to consister using MS365 email or something similar. Failure to follow our policy will result in quotas being reached and services being suspended until settings are altered.
Renewal of hosting accounts – failure to pay for your hosting account renewal within 30 days of the invoice date may result in your account being suspended without notice. Warnings will be given by email that the invoice is due and suspension will occur if invoice remains unpaid.
IMPORTANT: Suspended accounts will be fully deleted after 60 days of suspension status if payment for the account has not been received. All website files and data will be deleted along with the hosting account.
Cancellation of hosting account – you must give 14 days notice from the date of hosting account renewal noted on your renewal invoice if you wish to cancel your hosting account for the upcoming annual period.
You also agree that your web site(s) will not violate the Acceptable Usage Policy
Hosting Acceptable Usage Policy
The Internet is a powerful information and entertainment tool, we would expect our customers to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users.
Our acceptable use policy (“AUP”) is actively and strictly enforced. Offending content or users are removed from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken.
Common sense is the best guide as to what is considered acceptable use, however the following are unacceptable uses.
Illegality
In any form, including but not limited to the unauthorised distribution or copying of copyrighted software or other data, harassment, fraud, or trafficking in obscene material.
Undesirable Content
Certain types of content are not permitted on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software downloads may only be hosted if you are the writer and copyright owner of the software, all other software including freeware, shareware and trial software is forbidden. Audio and video downloads may only be hosted if you are the creator and copyright owner of the work.
Bulk Email
The use of our network to send bulk email whether opt-in or otherwise, and the use of bulk email to promote a site on our network is strictly forbidden.
Misuse Of Resources
Including but not limited to employing applications which consume excessive CPU time, memory or storage space. Chat/IRC, web proxy and mailing list scripts are not allowed on our network under any circumstances. Streaming media can be a drain on web server resources and as such is not allowed. CGI based message forums which use flat file databases are often found to use excessive system resources, to avoid disappointment please use a PHP/ASP message forum. The use of web cam applications which maintain a constant FTP connection uploading an image at regular intervals is forbidden.
If you are unsure about content you intend to place on our network, please check with us before you do. We reserve the right to determine what constitutes acceptable use.
Extended Hosting Terms & Conditions
Because we use numerous different servers with carefully selected and vetted host companies, each host company themselves will have their own terms and conditions for hosting. If you require a copy of the extended terms and conditions upon which your website resides, please get in touch and we can supply that.
Domain Names
It is the responsibility of the Client to keep track of their domain name registration periods and ensure renewal of their domain names takes place when upcoming or due. If a domain name expires, Linkni Internet Solutions Ltd can not be held liable for this. However, Linkni Internet Solutions Ltd will make reasonable effort to contact the client regarding domain renewal when domain is upcoming for renewal when Linkni Internet Solutions Ltd is alerted by the registration company of this upcoming renewal.
Transfer of Domain Names
If you wish to transfer your domain name to another registrar we will of course change the IPS-TAG or unlock the domain and provide Auth Codes. However if a domain has recently been renewed then outstanding monies will be required to be paid before domain(s) can be transferred out.
Cancellation of Domain Names
We operate the procedure of auto renewing client domain names. If you wish to no longer renew a domain via ourselves, you must give us at least 2 months notice before the domain renewal date. This is so we can switch off auto-renew and not be charged for the renewal. Otherwise you will be liable to pay for the renewed domain.
Updating of Websites – Text, Graphics, Photos, Designs, Trademarks and other Artwork
The Client represents to Linkni Internet Solutions Ltd and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Linkni Internet Solutions Ltd for inclusion in Client’s web site are owned by Client, or that Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect and defend Linkni Internet Solutions Ltd and its subcontractors from any claim or suit arising from the use of such elements furnished by the Client.
